WHAT IS ASBESTOS?

Asbestos is a set of six naturally occurring silicate minerals which had to be mined. They are commonly known by their colours, as blue asbestos (Crocidolite), brown asbestos (Amosite), white asbestos (Chrysotile). Some of the material properties are sound absorption, average tensile strength, resistance to fire, water, acid, and electricity. These desirable properties made asbestos very widely used in the UK up to 1999 where a total ban was enforced.

WHAT IS A "DUTY HOLDER"?

The duty to manage is placed on the person or organisation that has the main responsibility for maintenance or repair of non-domestic premises and common parts of domestic premises. The "duty-holder" may be the owner or, where there is an explicit agreement, such as a tenancy agreement or contract, the "duty-holder" may be the occupier or the landlord, sub-lessor or managing agent. It may also be the tenant. Where there is a tenancy agreement or contract, the extent of the duty will depend on the nature of that agreement. *L143_Reg4_93*
